CabSmart SERU Terms of Use

These Terms of Use (the “Terms”) set out the rules for using the CabSmart SERU mobile application (the “App”) and any related services we provide. Please read them carefully. By downloading, installing, accessing or using the App, you agree to be bound by these Terms.

1. About the App

CabSmart SERU is a paid educational and study tool designed to help users practise and learn material relevant to the Safety, Equality and Regulatory Understanding (SERU) assessment for London taxi / private hire licensing. The App provides study materials, summaries and practice questions.

The App is not an official test and does not book, administer or provide access to any official assessments. We do not guarantee that using the App will result in any particular outcome, including passing any assessment.

2. Eligibility and age restrictions

The App is intended for users aged 18 or over. By using the App you confirm that you are at least 18 years old.

If you are using the App on behalf of a business or other organisation, you confirm you have authority to bind that organisation to these Terms.

3. Accounts and security

To use certain features, you must create an account using an email address and complete our verification process.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must not share your account, password, verification codes or access credentials with anyone else. If you believe your account has been compromised, contact us as soon as possible at seru@cabsmart.co.uk.

4. Purchases, payments and refunds

The App is sold as a one-off purchase (currently priced at GBP 34.99, subject to change). Payments are processed by the relevant app store platform (Apple App Store or Google Play).

Refunds are handled in accordance with the policies of the platform through which you purchased the App. We do not process payments directly and may not be able to issue refunds ourselves. If you have a payment issue, please first follow the platform refund process and then contact us if you need support.

5. Licence and permitted use

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App for your own personal study purposes, in accordance with these Terms.

You must not rent, lease, sell, resell, sublicense, distribute, publish or otherwise make the App or its content available to any third party, except as permitted by law.

Where the app store platform offers device or family sharing features, those features are controlled by the platform. You remain responsible for ensuring your use of the App complies with these Terms.

6. Prohibited activities

You must not (and must not attempt to):

  • copy, reproduce, redistribute, republish, transmit, screen-record or screenshot any content from the App, except where permitted by law;
  • share, sell, trade or transfer your account or access credentials to anyone else;
  • reverse engineer, decompile, disassemble or otherwise attempt to derive source code from the App (except where this is permitted by law);
  • use the App in any way that is unlawful, fraudulent, harmful or that infringes the rights of others;
  • introduce malware, viruses or other harmful code, or attempt to interfere with the App’s security or operation;
  • use automated means (bots, scrapers) to access, extract or copy App content.

7. Intellectual property

All intellectual property rights in the App, including its software, design, layout, text (other than third-party materials), summaries, practice questions, databases and compilations, are owned by or licensed to CabSmart Seru Ltd.

Nothing in these Terms transfers ownership of any intellectual property rights to you. You may only use the App and its content as expressly permitted by these Terms.

8. Third-party materials and Transport for London content

The App may refer to, summarise, or include material that originates from third parties (for example, regulatory guidance or public sector publications). Any third-party trademarks and copyrighted materials remain the property of their respective owners.

Transport for London (TfL) is not affiliated with, does not sponsor, and does not endorse CabSmart SERU. Where TfL materials are referenced, they are referenced for study and informational purposes only.

If you believe any content in the App infringes your intellectual property rights, please contact us at seru@cabsmart.co.uk with sufficient detail so we can investigate and, where appropriate, remove or amend the content.

9. Availability, updates and changes

We may update, change, suspend or discontinue the App (or any part of it) at any time, including to reflect changes in law, guidance, platform requirements, security issues, or business needs.

We do not guarantee that the App will always be available, uninterrupted or error-free. We may restrict access for maintenance, upgrades or other operational reasons.

10. Your responsibility for using the App

You use the App at your own risk. You are responsible for how you rely on the information provided in the App and for ensuring you also consult official, up-to-date sources where necessary.

The App content is provided for general educational purposes only and is not legal advice, professional advice, or official licensing guidance.

11. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided “as is” and “as available”. We do not make any representations, warranties or guarantees that the App or its content will meet your requirements, be accurate, complete, reliable or up to date.

12. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

Subject to the paragraph above, to the maximum extent permitted by law, we will not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity, loss of data, or any loss arising from your reliance on the App content.

Where we are liable to you in connection with the App, our total liability will be limited to the amount you paid for the App (as applicable).

13. Consumer rights

If you are a consumer, you may have legal rights in relation to digital content that cannot be excluded or limited by contract. Nothing in these Terms affects those rights.

14. Marketing communications

If you choose to opt in, we may send you marketing and product updates by email. You can opt out at any time by using the unsubscribe link in our emails or by contacting us at seru@cabsmart.co.uk.

We do not send marketing SMS text messages because we do not collect users’ phone numbers for marketing purposes.

15. Privacy

We process personal information in accordance with our Privacy Policy, which is provided separately. The Privacy Policy forms part of the information we give you about how we handle your data.

16. Termination

You can stop using the App at any time by deleting it from your device and ceasing to use your account.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms or if we need to do so for security, legal or operational reasons.

17. Complaints and contact

If you have a complaint or need support, please contact us at seru@cabsmart.co.uk. We will try to respond within a reasonable time.

18. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute arising from or in connection with these Terms or the App.

19. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by updating the date at the top of these Terms or providing a notice in the App). Your continued use of the App after changes take effect means you accept the updated Terms.

20. Service Availability

We reserve the right to discontinue the app in the future. In such an event, we will provide advance notice to ensure users are informed.
